As the Secretary of the Department of Corrections, it is my pleasure to welcome you to the State of South Dakota’s Executive Clemency – Pardon homepage.
Here you can find information about the pardon process, determine whether you are eligible to apply for a pardon, and complete and submit your pardon application online.
Some offenses require a standard application while others are eligible for an expedited form. In order to determine which is appropriate for you, refer to Pardon Eligibility.
After you have determined which application fits your needs, Apply for a Pardon to create an account and select the application type you are eligible for. The more details you are able to provide in your application, the better. You may also fill out a paper application and mail it to the Parole Board office.
When your application is complete, you may submit it electronically to the office of the South Dakota Board of Pardons and Paroles. You will then be contacted regarding the date and time of your clemency hearing, or to notify you that your application is incomplete.
While the South Dakota Constitution provides only the Governor the authority to grant or deny pardons, the Governor will not consider a pardon unless it is first reviewed by and receives a favorable recommendation, from the Board of Pardons and Paroles.
